Terms and Conditions/Privacy Policies 101: The LegalMiga Library


We all know owning a business is a lot fun and also a lot of work. One aspect of owning a business that’s not so sexy and can be overwhelming is legal matters. As you start to grow, you realize that you’re often working with others - whether that's hiring employees and/or freelancers, gaining clients, collaborating with other businesses etc. This means you need contracts, agreements, disclaimers, trademarks, policies, forms, terms and conditions etc. (See, I told you it wasn’t sexy) Today we are chatting with a small biz attorney and founder of The Legalmiga Library to get the scoop on Terms and Conditions/Privacy. 





Q: Tell us who you are, why you started Legalmiga Library?

“Hi! I’m Taylor M. Tieman, Esq., a small business attorney & brand advocate. I’m an English Bull Terrier mom of two (and soon to be kiddo mama of one!) who loves Pilates, beach outings, a good Aperol spritz, and baseball (go Dodgers!). I am a former D1 softball player, and my placements are Cancer sun / Leo moon / and Scorpio rising.


In the professional realm, I’m rarely seen wearing anything but athleisure wear, except when I’m in court. Most days, I can be found drafting trademark applications, reviewing contracts, and assisting business owners in getting legally protected. We firmly believe that legal matters shouldn't be intimidating, and we are living proof that your attorney can also be your friend. 


I created The Legalmiga Library™ because after running my law firm, I quickly realized that part of being a zealous advocate for not just my clients - but a community of businesses owners - meant tackling the huge financial gap between the usual cost of legal resources and access to protection for their businesses and brands. “


Q: How can businesses ensure their privacy policies and terms of service comply with evolving legal regulations, such as GDPR (General Data Protection Regulation)


“The best way to keep up with changing regulations is to have an attorney on board, plain and simple. But the next best way is to get on email lists for attorneys or platforms (like our library!) that regularly update you on legal changes.”


Q: What are the potential risks for businesses that don't have clear and compliant privacy policies and terms of service on their websites?

 

“Businesses without clear and compliant privacy policies and terms of service risk legal trouble, hefty fines, and losing customer trust. They might face lawsuits, bad publicity, and operational chaos, all of which can hurt their reputation and finances.”


Q: How can businesses effectively communicate complex legal terms to their website viewers in a user-friendly manner?


“We love bullet points! Also FAQs are great. I think having good customer service is important, too.”


What steps can businesses take to update their privacy policies and terms of service to adapt to changes in regulations or business practices?


“Work with an attorney if possible on a yearly basis to check in to see what’s changed/what needs to be updated.”


In the event of a legal issue related to website privacy or terms of service, what steps should businesses take to protect their interests and resolve the issue efficiently?


“Save all evidence – correspondence, any data you have. Always make sure to keep record of when folks agreed to your website policies and terms, as well.”


What do you think of websites like Rocket Lawyer and LawDepot?


“I think they’re great for very broad agreements and a good start to see what you need. But we work with a ton of businesses in the online space and we’re actually drafting contracts based on what their needs are – so the needs of smaller groups, vs. the masses.”
